Comelec schedules prelim conference on petition vs. BBM on Nov. 26

MANILA – The preliminary briefing on the petition to dismiss the certificate of candidacy (COC) of presidential aspirant and former Senator Ferdinand “Bongbong” Marcos Jr. has been set on November 26 by the Commission on Elections (Comelec).

The Clerk of the Commission has scheduled the initial discussion next week, according to Comelec-Education and Information Department Director Elaiza Sabile-David.

“I was told by the director of the Office of the Clerk of Commission that when they issued the summons… the preliminary conference was already included. The preliminary conference is scheduled on Nov. 26,” she said in an interview on Monday.

The parties will be instructed to submit their respective memoranda following the conference.

“If there are no more questions, it (the case) would be submitted for resolution,” she added.

When asked how quickly the Comelec second division can make a decision, David said the commissioners might require additional time to resolve.

“We cannot tell. Hopefully, within the year,” she said.

A petition was filed before the Comelec earlier this month, appealing for Marcos’ certificate of candidacy to be cancelled. Marcos’ COC, according to the petitioners, contained many erroneous material claims.

In response, Marcos’ spokesperson, lawyer Victor Rodriguez, said they would address “this predictable nuisance petition” at the proper time and forum.
